Malcolm Bryant Sentenced to 35 Years To Life For The Homicide of Robert Prescott And Attempted Murder Of Another Individual

Rochester, NY- On Friday, November 14, 2025, New York State Supreme Court Justice Richard Healy sentenced 51-year-old Malcolm Bryant to 25 years to Life in the New York State Department of Corrections for killing Robert Prescott consecutive to 10 years in the New York State Department of Corrections plus 5 years of post-release supervision for the attempted murder of another Rochester man. The defendant was previously convicted by a jury of Murder in the 2nd Degree, Attempted Murder in the 2nd Degree, and two counts of Criminal Possession of a Weapon in the 2nd Degree


During the early morning hours of February 9, 2025, Rochester Police Officers responded to a parking lot on Thurston Road for reports of a man shot. Upon arrival, Rochester Police Officers located 48-year-old Robert Prescott with one gunshot wound to the torso. Mr. Prescott was immediately transported to Strong Memorial Hospital, where he died from his injuries.


Following a quick, but thorough, investigation by the Rochester Police Department, Malcolm Bryant was arrested for the murder. It was determined that Malcolm Bryant and a friend of the victim were involved in an altercation inside a bar on Thurston Road. After all involved parties exited the bar, Robert Prescott and his friend were walking to a parking lot on Thurston Road, when Malcolm Bryant approached both men from behind, firing shots at both victims.


The case was prosecuted by Special Assistant District Attorney Jonathan Jirik, of the Major Felony Bureau.


“From the moment this incident began, Malcolm Bryant had multiple opportunities to walk away. Instead, he chose to pursue two unarmed men and open fire, a decision that cost Robert Prescott his life and nearly took another,” said Assistant District Attorney Jonathan Jirik. “I must thank the Rochester Police Department for their swift investigation to identify andapprehend the defendant, but I also want to especially thank the second victim in this case. After he was gunned down by Malcolm Bryant, he cooperated, testified in court, faced his assailant, and through it all, only thought of friend, Robert Prescott. Because of his dedication to Robert and the excellent police work, we were able to secure today’s life sentence.”


“Robert Prescott was a devoted father whose loss left his family in deep mourning and his friends heartbroken,” said Monroe County District Attorney Brian Green. “Today’s sentence reflects the severity of the harm caused by Mr. Bryant, who violently took a life from this community and nearly killed another. That night, the defendant chose to escalate a dispute into lethal violence, causing an immeasurable loss for Mr. Prescott’s loved ones. We recognize that no outcome can fully ease their grief. However, we remain steadfast in our commitment to supporting victims and ensuring their voices are represented in the courtroom.”
