Chace Smith Sentenced to 5-15 Years for Manslaughter in the 2nd Degree

Rochester, NY- On Thursday, November 21, 2024, 31-year-old Chace Smith was sentenced by

New York State Supreme Court Justice Argento to an indeterminate sentence of 5 years to 15 years

in the New York State Department of Corrections, the maximum sentence allowed by law. The

defendant was previously convicted by a jury of Manslaughter in the 2nd Degree for the vehicular

homicide of Alivia Curl on November 26, 2022.


Around 2:30AM on November 26, 2022, Chace Smith and Timothy Tabron were involved in an

illegal street race approaching speeds of 88 mph on Brown Street, which is a residential area with

a posted speed limit of 30 mph. Chace Smith hit a vehicle driven by Alivia Curl, who died at the

scene of the crash. This case was investigated by the Rochester Police Department and the New

York State Police. Both Chace Smith and Timothy Tabron were arrested for the homicide.

Timothy Tabron previously pled guilty to Manslaughter in the 2nd Degree and is expected to be

sentenced to 3-6 years in the New York State Department of Corrections.


The case was prosecuted by Senior Assistant District Attorney Drew Kroft, of the Vehicular

Crimes Bureau and Assistant District Attorney Mikael Pelkey, also of the Vehicular Crimes

Bureau.


“Chace Smith made a series of bad choices that resulted in Alivia Curl’s death nearly two years

ago. He made a choice to drink. He made a choice to smoke. He made a choice to race. All of these

choices resulted in the death of Alivia Curl,” said Assistant District Attorney Drew Kroft. “I must

thank the Rochester Police Department and the New York State Police for conducting a detailed

investigation that resulted in the conviction and maximum sentence of Chace Smith. Alivia Curl

was known to be a shining light in her family and is a great loss to the entire community. While

they did not intend to take the life of Alivia, the reckless actions of Chace Smith and Timothy

Tabron caused her death.”


“Chace Smith was responsible for this violent, reckless, and completely unnecessary crash that

took the life of Alivia Curl,” said District Attorney Sandra Doorley. “Alivia’s death was not an

accident, it was a crash. A crash caused by the defendant’s choices to drink, smoke, drive, and

speed. It is my hope that before anyone gets behind the wheel of a car after consuming alcohol or

drugs, they think of Alivia Curl and her family. My heart goes out to her entire family, it is my

sincerest hope that they can continue their mourning in peace, outside of the criminal justice

system.”
