N. Clinton Shots Fired Arrest


Just before 5pm, yesterday, a Clinton Section Officer observed a Honda CRV that was involved in a shots fired incident in the 800 block of N. Clinton Avenue on July 15, around 10:30pm. Officers stopped the vehicle in the 1300 block of Norton Street and safely took two people into custody. The investigation led to Detectives from the Criminal Investigation Section drafting and executing a search warrant on the vehicle. Inside the vehicle, Officers located a Taurus .357 magnum revolver, various calibers of ammunition, and evidence relating to the shots fired incident the night before. The revolver had previously been reported stolen in the Town of Irondequoit. As a result, both suspects were transported to the Monroe County Jail and are expected to be arraigned this morning in Rochester City Court.


Michael Garcia, a 48-year old City of Rochester resident, is charged with Criminal Possession of a Weapon in the 2nd and 3rd Degree and Criminal Possession of Stolen Property in the 4th Degree. The Criminal Possession of a Weapon in the 3rd Degree charge is based upon Garcia’s six previous criminal convictions. He is additionally charged with Criminal Possession of a Weapon in the 2nd and 3rd Degree and Prohibited Use of a Weapon, relating to his possessing and firing a handgun on N. Clinton Avenue on July 15. Amber VanDuser, a 35-year old Fairport resident, is charged with Criminal Possession of a Weapon in the 2nd Degree and Criminal Possession of Stolen Property in the 4th Degree.
