ROCHESTER, N.Y. -- U.S. Attorney Michael DiGiacomo announced today that Jose Ricardo Gallegos-Moreno, 43, a native and citizen of Mexico, pleaded guilty before U.S. District Judge Frank P. Geraci, Jr. to illegal re-entry. He was then sentenced to time served and turned over to Immigration and Customs Enforcement.
Assistant U.S. Attorney Meghan K. McGuire, who handled the case, stated that Gallegos-Moreno is a citizen of Mexico without any legal status in the United States. He was physically removed from the United States on seven separate occasions in 2001, 2010, 2011, 2016, 2022, and 2024. Gallegos-Moreno also has three prior DWI convictions in the State of Texas. On November 18, 2025, he was found in Monroe County, New York.
This case is part of Operation Take Back America, a nationwide initiative that marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations (TCOs), and protect our communities from the perpetrators of violent crime.
The plea and sentencing are the result of an investigation by Customs and Border Protection U.S. Border Patrol, under the direction of Acting Chief Patrol Agent James D’Amato.
