Burglary / Homicide Investigation


Rochester, NY - At approximately 4:30 a.m. this morning, a resident in the 300 block of Avery Street called 911 after hearing gunshots coming from a nearby home. Shortly thereafter, Monroe County 911 received a second call from a homeowner, who reported that he had shot an individual who had broken into his residence.


Officers responded to the scene, where they were met by the homeowner. Upon entering the residence, officers located the intruder in the kitchen. He was pronounced deceased at the scene.


The homeowner is cooperating fully with investigators. He possesses a valid New York State pistol permit, and the handgun used in the incident was legally owned and registered.


Investigators determined that the residence had been burglarized at least twice since June of this year.


The deceased individual was not known to the homeowner. He was on parole for a previous burglary conviction and was known to law enforcement. His identity is being withheld pending confirmation and notification of next of kin.


At this time, no criminal charges have been filed. The investigation remains ongoing, and all evidence and investigative findings will be submitted to the Monroe County District Attorney's Office for review.
